To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You agree NOT to use the Service to:

• Create content that is illegal, harmful, threatening, abusive, or defamatory
• Generate images depicting real people without their consent
• Create deepfakes or misleading content intended to deceive
• Produce content that infringes on intellectual property rights
• Generate explicit, adult, or NSFW content
• Create content promoting violence, hate speech, or discrimination
• Attempt to circumvent usage limits or security measures
• Resell or redistribute the Service without authorization

Violation of these policies may result in immediate account termination without refund.

The Service operates on a credit-based system. Credits are consumed when generating or editing images. Key terms:

• Credits are non-refundable and non-transferable
• Unused credits may expire according to your plan terms
• Subscription renewals are automatic unless cancelled
• Price changes will be notified in advance

Your Content: You retain ownership of images you upload. By uploading content, you grant us a license to process and store it for providing the Service.

Generated Content: Images generated through our Service are licensed to you for commercial and personal use, subject to the Acceptable Use Policy. You may use generated thumbnails on YouTube, social media, and other platforms.

Our Property: The Service, including its software, design, and branding, is owned by ThumbnailMakerr and protected by intellectual property laws.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE:

• Uninterrupted or error-free operation
• Specific results from using the Service
• That generated content will increase views or engagement
• Accuracy or reliability of AI-generated content

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THUMBNAILMAKERR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE.

Our total liability shall not exceed the amount paid by you for the Service in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless ThumbnailMakerr, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

• Your use of the Service
• Your violation of these Terms
• Your infringement of any third-party rights
• Content you upload or generate using the Service

We may terminate or suspend your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination:

• Your right to use the Service will immediately cease
• Your data may be deleted after a reasonable retention period
• No refunds will be provided for unused credits

You may cancel your account at any time through your account settings.

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ThumbnailMakerr operates, without regard to conflict of law principles.
